Welcome to ArtMoMag (“ArtMoMag,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of https://www.artmomag.comand its associated podcast, YouTube channel, and social media presence (together, the “Platform”).
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. Who We Are
ArtMoMag is a magazine of art, culture, and the human stories that live between them — dispatches from lives that feel ordinary to the people living them, and revelatory to everyone else. We publish the artists, thinkers, and unnamed voices whose work maps the emotional and cultural terrain of being human somewhere specific, in a particular body, at a particular moment in history.
We extend that same practice of attention across formats: articles and photo essays on this Site, conversations on our podcast (available on Spotify and Apple Podcasts), video on our YouTube channel, and shorter dispatches across our social media handles.
ArtMoMag takes its name, and its instinct for discovery, from ArtMoshai, our sister platform for art and auctions. ArtMoshai is a separate platform with its own terms and conditions, and nothing in these Terms governs your use of ArtMoshai or any transaction conducted there. Where we link to ArtMoshai, you will be leaving this Platform and should review ArtMoshai’s own terms before proceeding.
2. Eligibility
By using the Platform, you represent that you are at least 16 years old, or the age of digital consent in your jurisdiction, and that you have the legal capacity to enter into these Terms.
3. Accounts
Some features — such as commenting, pitching a story, or subscribing to updates — may require an account or a submitted email address.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- You agree to provide accurate information and keep it current.
- We may suspend or terminate accounts that violate these Terms.
4. Our Content
All articles, essays, photography, illustrations, podcast episodes, video, audio, layouts, and other material we publish (the “Content”) are owned by ArtMoMag or our contributors and licensors, and are protected by copyright and other intellectual property laws.
You may read, listen to, watch, and share links to our Content for personal, non-commercial use. You may not reproduce, republish, rebroadcast, re-upload, or otherwise distribute our Content — including podcast audio or YouTube video — on another platform or in another publication without our prior written consent or that of the applicable rights holder.
Short excerpts for the purpose of commentary, criticism, or citation, with clear attribution and a link back to the original, are welcome and do not require our permission.
5. The People We Write About
Because our work moves through people’s actual lives — their homes, their rituals, their private histories — we take the relationship between ArtMoMag and the subjects of our stories seriously.
- Where a story is based on interviews or firsthand accounts, we seek the informed participation of the people whose lives it draws on, and we are attentive to what they choose to share and what they choose to hold back.
- Where a subject’s identity is withheld or altered at their request — one of the “unnamed voices” we publish — that anonymity is a deliberate editorial choice, not an oversight, and we do not disclose identifying details on request from third parties.
- If you are the subject of a piece and have a concern about how you or your story have been represented, please contact us at artmoshai@gmail.com; we take these conversations seriously and will respond in good faith, though publishing a correction, update, or removal remains an editorial decision.
6. Submissions and Pitches
If you submit a pitch, manuscript, photograph, artwork, audio, or other material to us for editorial consideration (“Submissions”), the following applies:
- You retain ownership of your Submission. Submitting a pitch does not transfer any rights to us; rights are only assigned or licensed if and when we commission or accept the work under a separate written agreement.
- You represent that you own or have the rights to what you submit, and that it does not infringe anyone else’s copyright, privacy, or other rights.
- We receive a high volume of pitches and cannot guarantee a response, feedback, or that unsolicited material will be returned or credited if unused.
- Please do not send us anything you are not comfortable having reviewed by our editorial team.
For comments or shorter User Submissions (e.g., comments beneath an article), you grant ArtMoMag a non-exclusive, worldwide, royalty-free license to display, reproduce, and moderate that content in connection with operating the Platform. We may remove any comment or contribution at our discretion.
7. Podcast, YouTube, and Social Media
Our podcast is distributed through Spotify and Apple Podcasts, and our video content through YouTube; both are also governed by those platforms’ own terms of service, which apply in addition to these Terms when you use those services. The same is true of any social media handle where we post — your use of those platforms is subject to that platform’s own rules.
We are not responsible for the availability, functionality, or content moderation of third-party platforms, and features such as comments, likes, or messages sent to us through them are subject to those platforms’ own privacy and data practices.
8. Acceptable Use
When using the Platform, you agree not to:
- Use it for any unlawful purpose or in violation of these Terms;
- Upload or transmit viruses, malware, or other harmful code;
- Attempt to gain unauthorized access to the Platform or its systems;
- Scrape, harvest, or bulk-download Content using automated means without our consent;
- Impersonate any person, or misrepresent your affiliation with ArtMoMag or ArtMoshai;
- Harass, threaten, or attempt to identify or “unmask” any person whose identity we have chosen to withhold;
- Interfere with or disrupt the operation of the Platform.
We reserve the right to restrict or terminate access for violations of this section.
9. Newsletters and Communications
If you subscribe to our newsletter or mailing list, you consent to receive periodic emails about new stories, episodes, and features. You may unsubscribe at any time via the link in any email or by contacting us directly.
10. Data Protection
Our collection and use of personal data — including your rights under the GDPR — is described separately in our Data Protection Policy, which forms part of these Terms by reference. By using the Platform, you also agree to that Policy.
11. Advertising and Third-Party Links
The Platform may include sponsored content, partnerships, or links to third-party sites, including ArtMoshai, galleries, artists, and event organizers. We are not responsible for the content or practices of third-party sites, and inclusion of a link does not imply endorsement. Sponsored or paid content is clearly identified as such.
12. Intellectual Property Complaints
If you believe Content on the Platform infringes your copyright or other rights, contact us at artmoshai@gmail.com with:
- A description of the work you believe is infringed;
- The location of the material on the Platform;
- Your contact information;
- A good-faith statement that the use is unauthorized;
- A statement, under penalty of perjury, that you are the rights holder or authorized to act on their behalf.
We will review valid notices and take appropriate action, which may include removing or restricting access to the material.
13. Disclaimers
The Platform and all Content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that the Platform will be uninterrupted, timely, or error-free, or that any story, interview, or account published reflects a complete or objective record of events — our work is editorial and interpretive by nature, not a claim to comprehensive fact-finding. Opinions expressed by contributors are their own and do not necessarily reflect the views of ArtMoMag.
14. Limitation of Liability
To the fullest extent permitted by law, ArtMoMag, its owners, employees, and contributors are not liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, arising from your use of, or inability to use, the Platform, even if advised of the possibility of such damages.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless ArtMoMag and its owners, employees, and contributors from claims, damages, losses, and expenses (including legal fees) arising from your use of the Platform, your Submissions, or your violation of these Terms.
16. Changes to the Platform or These Terms
We may update or discontinue any part of the Platform at any time. We may revise these Terms from time to time; material changes will be reflected in the “Last updated” date above. Continued use after changes take effect constitutes acceptance of the revised Terms.
17. Termination
We may suspend or terminate your access to the Platform at any time, with or without cause or notice, including for violations of these Terms.
18. Governing Law
These Terms are governed by the laws of Spain, without regard to conflict of law principles. Disputes arising under these Terms will be resolved exclusively in the courts of Barcelona, Spain.
19. Severability
If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions remain in full effect.
