This Data Protection Policy explains how ArtMoMag (“ArtMoMag,” “we,” “us,” or “our”) collects, uses, and protects personal data in connection with https://www.artmomag.com, our podcast, our YouTube channel, and our social media presence (together, the “Platform”), and describes the rights available to you under the EU General Data Protection Regulation (GDPR) and applicable Spanish data protection law.
This Policy applies to everyone who uses the Platform, regardless of where you are located, and should be read alongside our Terms and Conditions.
1. Who We Are
ArtMoMag is based in Spain and is the data controller responsible for the personal data described in this Policy. For any question about how your data is handled, or to exercise any of the rights described below, contact us at artmoshai@gmail.com.
2. What Personal Data We Collect
Depending on how you interact with the Platform, we may collect:
- Contact details — such as your name and email address, when you subscribe to our newsletter, submit a pitch or Submission, leave a comment, or write to us directly.
- Account information — if the Platform offers accounts or commenting, basic profile details you provide.
- Correspondence — the content of any message you send us, including if you are the subject of a story and contact us with a concern.
- Technical and usage data — such as IP address, browser type and version, device information, and pages visited, typically collected automatically via cookies or similar technologies.
- Podcast and video interaction data — collected by Spotify, Apple Podcasts, and YouTube according to their own privacy practices when you listen to or watch our content on those platforms (see Section 8).
We do not knowingly collect special categories of data (such as health, religious belief, or political opinion) about our readers, except where a reader voluntarily shares such information with us in correspondence or a submission — in which case we handle it with additional care and only for the purpose you shared it.
3. Why We Process Your Data, and Our Legal Basis
| Purpose | Data Used | Legal Basis |
|---|---|---|
| Sending our newsletter | Name, email | Consent |
| Reviewing a pitch or Submission | Name, email, submitted material | Steps taken at your request prior to a potential agreement; legitimate interest |
| Responding to correspondence, including concerns from story subjects | Name, email, message content | Legitimate interest in responding to you; legal obligation, where applicable |
| Operating comments or accounts | Account details, comment content | Consent; legitimate interest in moderating the Platform |
| Keeping the Platform secure and functioning | Technical/usage data | Legitimate interest; consent (for non-essential cookies) |
| Publishing editorial content that includes personal data (e.g., an interview) | Data shared by story subjects | Journalistic purposes (see Section 9); consent of the subject as part of the editorial process |
We do not sell your personal data, and we do not use it for automated decision-making or profiling that produces legal or similarly significant effects on you.
4. Cookies and Similar Technologies
The Platform may use cookies or similar technologies for:
- Essential functionality — required for the Platform to work (e.g., remembering cookie preferences);
- Analytics — to understand how the Platform is used, in aggregate;
- Embedded content — podcast players or embedded YouTube videos may set their own cookies once you interact with them, governed by that provider’s own policy.
Where required by law, we will ask for your consent before setting non-essential cookies, via a cookie banner or preference tool on the Platform. You can withdraw consent at any time through that tool or your browser settings. Disabling cookies may affect some functionality of the Platform.
5. How Long We Keep Your Data
We keep personal data only for as long as necessary for the purpose it was collected:
- Newsletter subscribers: for as long as you remain subscribed, plus a reasonable period to process your unsubscribe request.
- Correspondence and submissions: for a reasonable period after our exchange concludes, to allow us to respond, follow up, or maintain a record if the correspondence relates to a published story.
- Technical/analytics data: typically retained in aggregated or anonymized form beyond a short identifiable window.
Where personal data is incorporated into a published story with the subject’s participation, it may be retained indefinitely as part of the published editorial record, consistent with Section 9 below.
6. Who We Share Data With
We may share personal data with:
- Service providers who help us operate the Platform — for example, email newsletter platforms, website hosting, and analytics tools — acting on our instructions and bound by appropriate data protection terms.
- Podcast and video distribution platforms (Spotify, Apple Podcasts, YouTube), which receive data directly from you when you use those services, under their own privacy policies.
- Legal or regulatory authorities, where required by law.
We do not share your personal data with third parties for their own independent marketing purposes.
7. International Data Transfers
Some of the third-party service providers we use may process personal data outside the European Economic Area (EEA). Where this occurs, we take steps to ensure the transfer is protected by appropriate safeguards recognized under the GDPR, such as the European Commission’s Standard Contractual Clauses or an adequacy decision covering the destination country.
8. Third-Party Platforms
Our podcast (Spotify, Apple Podcasts), YouTube channel, and social media handles are operated by third parties with their own privacy policies. When you interact with our content on those platforms — subscribing, commenting, messaging — your data is also processed according to that platform’s own privacy practices, which we encourage you to review separately.
9. Journalistic Content and Data Protection
ArtMoMag publishes editorial and journalistic content, including personal stories, interviews, and — at times — anonymized or pseudonymous accounts shared at a subject’s request.
- Where someone participates in a story, we seek their informed participation regarding what will be published, consistent with our editorial practices described in our Terms and Conditions.
- The GDPR recognizes a journalistic exemption that balances data protection rights (such as erasure) against freedom of expression and the public’s right to information. As a result, some rights described in Section 10 below may be limited in relation to content already published as part of a story, even where they would otherwise apply to our administrative records (such as a subscriber list).
- If you are the subject of a piece and have a concern about your data or representation, contact us at artmoshai@gmail.com — we respond to these in good faith, though whether to correct, update, or remove published content remains an editorial decision made on a case-by-case basis.
10. Your Rights Under the GDPR
If you are located in the EU/EEA — and, as a matter of practice, wherever you are located — you have the right to:
- Access the personal data we hold about you;
- Rectify inaccurate or incomplete data;
- Erase your data (“right to be forgotten”), subject to the exceptions described in Section 9;
- Restrict our processing of your data in certain circumstances;
- Object to processing based on legitimate interest;
- Data portability, for data you provided to us and that we process by automated means on the basis of consent or contract;
- Withdraw consent at any time, without affecting the lawfulness of processing carried out before withdrawal;
- Lodge a complaint with a supervisory authority — in Spain, the Agencia Española de Protección de Datos (AEPD), www.aepd.es.
To exercise any of these rights, contact us at artmoshai@gmail.com. We will respond within the timeframes required by law (generally within one month of a verified request).
11. Children’s Data
The Platform is not directed at children, and we do not knowingly collect personal data from anyone under the age of 16. If you believe a child has provided us with personal data, please contact us so we can delete it.
12. Data Security
We take reasonable technical and organizational measures to protect personal data against unauthorized access, loss, or misuse. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
13. Changes to This Policy
We may update this Policy from time to time to reflect changes in our practices or in applicable law. Material changes will be reflected in the “Last updated” date above.
